Zero Tolerance Drug & Alcohol Policy

Purpose

Let's Work USA Inc. is committed to maintaining a safe, productive, and high-quality work environment. Alcohol and drug abuse threaten employee health, safety, and the security of our clients, equipment, and facilities. To protect everyone, Let's Work USA maintains a Zero Tolerance Drug & Alcohol Policy, prohibiting use or abuse of these substances on or off the job.

Employee Responsibilities

Employees must:

Report to work fit for duty and free from illegal drugs and alcohol.
Use prescribed medications lawfully and consult their doctor regarding fitness for duty.
Inform Let's Work USA of any work restrictions before the start of a shift.

Failure to comply may result in immediate termination.

Prohibited Conduct

While on duty, operating vehicles, on company/client premises, or performing company-related work offsite, employees may not:

Use, possess, buy, sell, manufacture, or dispense illegal drugs (including paraphernalia).
Be under the influence of alcohol or illegal drugs.
Possess or consume alcohol while performing company duties.
Have detectable levels of illegal drugs, controlled substances, or alcohol in their system.
Perform work impaired by prescribed medications without proper disclosure.

Illegal drugs or paraphernalia may be reported to law enforcement.

Required Testing

Pre-employment: Conditional job offers require passing a drug test. Refusal disqualifies employment.
Post-employment: Mandatory drug screening after 37 days at Waste Management. Failure/refusal = immediate termination.
Reasonable Suspicion: Employees may be tested if management observes behaviors indicating impairment (documented with checklist).
Post-Accident: Testing required if employees cause or contribute to accidents causing injury or property damage.

Refusal to test is treated as a positive result and results in immediate termination. Employees may not drive themselves to testing facilities.

Collection & Testing Procedures

Testing may include breath, blood, or saliva samples.
Breath alcohol of 0.04 or higher triggers a second test; results are determinative.
Employees testing positive will be terminated immediately. Time spent testing is paid until results are received.

Confidentiality

Test results, dependencies, and medical explanations are confidential and stored separately from personnel files.
Information may be shared with management on a need-to-know basis or disclosed in legal proceedings if relevant.

Inspections

Let's Work USA may inspect premises, employees, contract staff, and visitors for drugs, alcohol, or contraband.
Refusal or possession of contraband may result in immediate termination.

Crimes Involving Drugs

Manufacturing, distributing, dispensing, possessing, or using illegal drugs on company premises or during company work is prohibited.
Misuse of legally prescribed or over-the-counter drugs is prohibited.
Law enforcement may be notified if criminal activity is suspected.

Key Definitions

Company Premises: Includes buildings, offices, facilities, grounds, parking lots, lockers, and vehicles owned, leased, or managed by Let's Work USA or client sites.
Illegal Drug: Any federally controlled substance not used under healthcare supervision.
Refusal to Operate: Obstructing testing, missing a test, submitting adulterated samples, or failing to provide specimens without valid medical reason.
Under the Influence: Alcohol = 0.04 BAC or observable impairment. Drugs = positive test or misuse of prescription drugs without valid prescription.

Background Check Authorization

I hereby authorize Let's Work USA Inc., its designated agents, and representatives to conduct a comprehensive review of my background, which may result in a consumer report and/or investigative consumer report for employment and/or volunteer purposes.

I understand that the scope of such reports may include, but is not limited to, the following areas:

Verification of Social Security number
Credit reports
Current and previous residences
Employment history
Education background
Character references
Drug testing
Civil and criminal history records from any criminal justice agency in federal, state, or county jurisdictions

I further authorize Choice Screening, a private corporation and/or public agency, to release any and all information, verbal or written, pertaining to me, to Let's Work USA Inc. or its agents. Employee Acknowledgment

Assignment and At-Will Employment

I, the undersigned employee, acknowledge that:

I must pass Let's Work USA Inc. protocol screening before being assigned to a client company.
I have been accepted as an employee of Let's Work USA Inc., and either I or Let's Work USA Inc. may terminate the employment relationship at any time, as I am an at-will employee.

I understand and agree that:

While performing work for a client company, even if Let's Work USA Inc. does not receive payment from the client, I will be paid at least the applicable minimum wage and legally required overtime by Let's Work USA Inc.
All compensation for work performed for a client company must be paid by Let's Work USA Inc.
It is strictly prohibited to accept compensation for such work from any source other than Let's Work USA Inc. without written consent.
Acceptance of unauthorized compensation will result in immediate termination, effective the beginning of the pay period in which it was received.

I understand that if I receive unauthorized payment from another source, I will not be considered an employee of Let's Work USA Inc. for that work, and therefore will not be covered under Let's Work USA Inc.’s workers’ compensation policy. (This does not apply to tips from patrons.)

Drug and Alcohol Testing

I agree to comply with any drug and alcohol testing policy adopted by Let's Work USA Inc., including:

Post-accident testing following any work injury, regardless of my ability to give consent at the time. This document serves as my consent.
Marijuana is considered a controlled substance, and medical marijuana will not be recognized as a valid prescription unless state law mandates otherwise.
Positive tests for marijuana without prior submission of a valid prescription to Let's Work USA Inc. will be treated the same as any other positive test.

Reporting Discrimination, Harassment, or Retaliation

I acknowledge that:

I must promptly report all incidents of discrimination, harassment, or retaliation to Let's Work USA Inc., regardless of the offender’s identity or position.
The client company is responsible for investigating and addressing complaints. If not resolved, Let's Work USA Inc. will take steps to ensure compliance with federal and state laws, protecting my privacy and preventing retaliation.
Because Let's Work USA Inc. does not control client operations, I understand that reporting incidents promptly is necessary for appropriate action to be taken.

Safety Requirements and Work Practices

I agree to:

Follow all safety procedures and practices, including those required or recommended by government agencies, OSHA, the client company, and Let's Work USA Inc.
Immediately report any work-related accidents or injuries to Let's Work USA Inc. and my supervisor at the client company.
If I require treatment for a work-related injury:
- Notify Let's Work USA Inc. and my client company supervisor.
- Visit Let's Work USA Inc.-directed physicians for initial treatment unless urgent care is required.
- Provide a Medical Authorization for Treatment form at the facility.
- Notify Let's Work USA Inc. or the workers’ compensation carrier if referred to a specialist.
- Only visit specialists directed by Let's Work USA Inc.’s workers’ compensation carrier.
I understand that failure to follow these procedures may result in disciplinary action, including written warnings.
I will report any safety violations encountered in my assigned workplace.
California Residents: Labor Code Section 5400 requires reporting work-related accidents within 30 days; failure may result in claim denial.

Medical Provider Network (Workers’ Compensation)

To ensure timely and appropriate care for work-related injuries:

Report all injuries promptly to Let's Work USA Inc. and your supervisor.
Contact Let's Work USA Inc. or claims adjuster for referrals to medical specialists.
All medical treatment must be through the Medical Provider Network (MPN) unless authorized otherwise.
Direct all questions regarding the level of care to your Primary Care Physician (PCP).
A directory of approved medical providers is available upon request.
